From the Where2sing.com forum:

I have not looked at their Terms & Conditions however I would have a guess and say that even if I was responsible it will be under US law (where the website is based) And then what of the karaoke operators who permitted me to record the songs. I recorded those live on stage with three of them...and another in his garage. Do you know David that there are more than 7 other sites like that. I cannot upload on every one of them..I am on dial-up (I am on a Disability Support Pension) and it will take me too long. The other one I upload onto is (site removed) ....user name (***) What I cannot understand though is this. These sites have been there for some 10 years (since 1999)..and no legal action was taken??? Does'nt that tell you that perhaps no legal action can be taken against them..otherwise it surely would have been taken in 10 years would'nt you say? regards

I know that websites are responsible under the country in which their domain is registered, but I think it would be extremely difficult for US law to apply to an Australian resident in Australia without there being some cross-border cooperation. However, this is about the legality, not so much the ability for it to be enforced. The hosts who recorded your performance should already have a licence to do so, and part of its conditions will be that the music and your voice are recorded on one track so that they cannot be separated - I don't know what rights that gives you to use the recording for a public performance, but I suspect the terms will include only your personal use. I will ask that question in the W2S forums, so you may see any answer there. There are thousands of sites that use music illegally, and many have done so for a long time - it's a case of large sites being prosecuted, and that does happen. Even the MIDI music tracks you hear on sites are illegal. The law is very specific, but there's a large cost associated with prosecuting.
