Google and it came up. Daretosing is NOT a commercial site as regards
the uploads. It is NOT selling the songs for profit or charging people
to hear them.It is just exhibiting them for '"sharing".Other people are
listening to them and they are NOT paying for the privilege.It's exactly
the same as if I play them in a party. This is why the definition of a
"public performance/broadcasting under the law MUST be: 1) paying
audience 2) televised. If this is not defined then even if an audience
in a party situation (not paying)hears them...that would be also an
infringement of copyright Just because Daretosing advertises certain
enterprises does not mean that it is infringing copyright...it will only
does so if it uses the songs FOR COMMERCIAL USE.
Regards REPLY from David Dare2sing.com is a commercial website because it earns money. But it really doesn't matter, because it's illegal for you to upload your songs anyway.
Have you not heard of the people facing hundreds of thousands of dollars in fines, and even jail, for file-sharing? You're doing exactly the same by uploading your songs. If you want to do this legally, then you need to either get the permission of all the copyright holders, or obtain a licence from APRA and AMCOS which has the same effect. If you really don't believe me or the actual Act, and only want to misinterpret someone else's vague interpretation of the Act, then you'd be best to ask APRA.
Or maybe I can ask you another way that make make better sense... what permissions have you obtained in writing, or what licence do you hold,. that specifically authorises you, by name, to upload those songs to a website?
And do you really believe that if this were legal, that W2S wouldn't be doing this?
