From the Where2sing.com forum:

As to the question"to upload a song onto a website" there are unanswered questions for example: 1) Would this website have to based in Australia? 2) Who would require a licence...the individual who is uploading the song...or the wesbite? So for example...say I obtain a licence in Australia to upload songs on Daretosing..and Daretosing HAS NOT a licence...this remains illegal would'nt it. So what is the use ? I mean David....you must address these questions. Furthermore say I upload songs on a website based in the USA..and website HAS NOT a broadcasting licence...what has that got to do with me? The website should tell me "sorry cannot broadcast your song..no licence". But it does not...am I to blame? David....David....You had better contact those authorities again and clarify this position regards

No need to ask APRA again because the answers are already clearly in their response. You need a licence to upload songs, and the website needs a licence to publicly broadcast them. You are obviously not responsible for the actions of the website, but you are responsible for your own actions of uploading songs. You are in Australia, and under the jurisdiction of APRA. Websites are under the jurisdiction of the country in which its domain name is registered, which in the case of DareToSing.com is (LA) USA. At this stage we obviously don't know whether this website does have the required licence, but that's not our affair. I see that you are continuing to illegally upload songs to DareToSing.com, so I guess you are not concerned about infringing copyright by doing so?
