| From the Where2sing.com forum: David, the general opinion of the net community doesn't set the rules or pay for this company's licences! I have it in writing from this supplier that what you've just stated is not the fact. In fact as long as the pub or club has all the appropriate APRA licences and that the download is played from the same machine it was downloaded on, it IS perfectly legal as 1/ there was no format shifting and 2/ it's paid for. The site mentioned below by me is fully approved in the US for sales to commercial users and has also been sanctioned for the same by various organisations around the world, including AMCOS/APRA. I have stated this many times before yet you and some others seem to go off on some unclear tangent thinking this subject is difficult and confusing. I have read all the licence forms and their associated instructions and rules. As far as I'm concerned it is very clear. 1/ make sure your venue is licenced with APRA. 2/ Make sure you use either your originals or have a format shifting licence to cover your copies. End of story. Now would you like the prices for both as well?? I have a very clear understanding of those too. Yet we still argue it! Why? Because you wouldn't be happy unless you created a two sided 'sensationalist & controversial' event as journos are a want to do! ( I know too many so I also know how they work as well) When the reality is just sooooo booooring! Now would you like that clarified?? :|
The only thing in this whole subject that isn't clear is whether this toothless tiger can actually legally prosecute. Now that is a point worth arguing. And if they can't, why would we bother wasting our money on their licences. So from my point of view, I would hope the final answer there is that they can. But unfortunately, knowing the inefficiencies of regulatory bodies in this country, it won't surprise me if they can't.
