TTT, you're correct that there's almost no one other than the host able to know the legality of his tracks - downloaded from whence, under what Tricerasoft/other agreement terms of the time, onto which computer, coped to where, etc.
LB, spot on - policing in the traditional sense won't work, and enforcement for such an ethereal item as a music track is almost impossible. APRA solution for 'composition rights' licencing/payment takes a vague blanket approach that may well provide minimal benefit for the real songwriters, and as far as the 'sound recording' copyright holders (Capital, Sunfly etc.) it's really up to them to find some commercial way to protect their interests. However, maybe we are moving forward on one subject, and that's the seeming consensus by 'sound recording' companies that one download is for one hard drive.
Just a note on contract law, the Terms and Conditions of sale covering downloads are those specified at the time - hosts would be wise to print a copy for filing with their invoices whenever downloading. The T&C can *not* be applied retrospectively, as there must be offer and acceptance for the T&C to be valid - the offer is by way of T&C on the site prior to your download, and your acceptance is by way of payment and download.
